General questions about your claim

These are the questions our clients ask us most often, regardless of the type of accident they have suffered: how compensation is calculated, who has to pay it, how long it takes to receive it, or what documentation is needed. If your question is more specific —for example, about a motorbike accident, being hit by a vehicle, or a fall— see the specific questions section at the end of this page.

General questions

What we get asked most

Who has to pay compensation for a traffic accident?
As a general rule, the insurance company of the party responsible for the accident. If the person responsible cannot be identified or was driving without insurance, compensation can be claimed through the Insurance Compensation Consortium. Under no circumstances should the injured party have to advance any money for their claim to be processed.
How much is paid per day off work after a traffic accident?
The amount per day off is calculated according to the current traffic compensation scale, distinguishing between days that prevent you from carrying out your usual activity and those that do not. It is common for there to be a discrepancy between the insurer's assessment and what the injured party is actually entitled to; our experts review every case so that no claim falls short of what is owed.
How long does it take to receive compensation for a traffic accident?
Every accident is different and recovery times can vary considerably, which directly affects when the final assessment can be closed. If an amicable agreement is reached with the insurer, the process is usually faster; if it is necessary to go to trial, the timelines are longer. Advance payments can be requested during recovery.
Is it necessary to go to trial to receive compensation?
Not always. Many cases are resolved through an amicable agreement with the insurer when the offer matches what is actually owed. We only go to court when the insurer does not offer fair compensation, and we always inform you before taking that step.
What documents do I need to start my claim?
As a starting point, the police report or amicable accident statement, emergency and follow-up medical reports, and any communication you have received from the insurer are useful. Don't worry if you don't have everything from the outset: our team helps you gather the necessary documentation during your free consultation.
Can I change lawyers if I already have one handling my case?
Yes, you can change lawyers at any point in the process, as long as you have not signed or accepted compensation. We offer you a free second opinion on your case before you decide whether you want us to take over your claim.
What steps do I need to follow to claim compensation?
In summary: a free consultation, an individual assessment of your case, an expert evaluation of injuries and damages, negotiation with the insurer and, if necessary, legal proceedings. You can see the full process, step by step, in the "How We Work" section of our About Us page.
