In January 2016, a new scale regulating compensation for traffic accidents came into effect, a fact that is being taken advantage of by insurance companies to pay amounts lower than those they are entitled to (despite the fact that no reduction was intended).

In fact, its purpose was precisely the opposite: to adjust the amounts to the current cost of living. However, this scale is significantly more complex than the previous one. Therefore, without proper advice, the injured party in an accident may end up losing much of the compensation to which they are entitled.

Among other things, this new scale has modified the criteria and the way to claim compensation for traffic accidents.

Now, in many cases, civil (out-of-court) proceedings must be pursued instead of criminal ones. This shortens the timeframe and significantly complicates the process. Failure to obtain a detailed medical report of the injuries from a healthcare professional within 72 hours of the accident can lead to the failure of claims.

Insurance companies are taking advantage of the doubts and general lack of understanding that this legislative change has generated among the public. According to various studies conducted during the first quarter after the reform, the amounts paid out are now significantly lower than those paid before 2016 (some companies are even paying half the amounts stipulated by law). These are no longer isolated cases, but rather a modus operandi followed by the entire sector.
